OFFICIAL TERMS AND CONDITIONS
1. Program Dates: The New Runner Incentive Program (the "Program") begins on February 1, 2011 and ends on February 29, 2012 (the "Program Period").
2. Eligibility: Open only to those legal residents of the United States or D.C. who are 18 years of age or older at time of registration to Run Happy University. Employees of Brooks® Sports, Inc., ("Sponsor"), Participating Retailers, their respective parent companies, affiliates, subsidiaries, divisions, advertising and promotion agencies, and Marden-Kane, Inc. ("Released Entities"), and their immediate families (spouse, parents, children, siblings, and their respective spouses), and their respective household members, whether related or not, are not eligible to participate. Limit one (1) new Runner Kit per person per email address. Multiple Program participants are not permitted to share the same email address. Please allow 2 - 4 weeks for delivery of Runner Kit.
3. General Conditions: Program is void in Canada, Puerto Rico, U.S. Virgin Islands and U.S. military bases outside the U.S., and wherever else or otherwise restricted by law. All brand and product names being offered in the Runner Kit are registered trademarks of their respective owners. Any and all warranties and/or guarantees on the items included in the Runner Kit (if any) shall be subject to the manufacturer's terms, and winner agrees to look solely to such manufacturer for any such warranty and/or guarantee. Neither of the Released Entities noted above nor any Internet access providers are responsible for lost, stolen or undeliverable Runner Kits which will not be replaced; for incorrect entry of personal information by participants in the Program; for technical malfunctions of any network or computer equipment software or any combination thereof or lost/delayed data transmission, or for files that are incomplete, undecipherable, late, lost or misdirected. Participants release and hold harmless the Released Entities from any and all liability, claims, losses, actions, damages, injuries, or losses of any kind, including but not limited to, personal injury or death, that may result from participation in the Program, or the acceptance, possession, use, misuse, or non-use of any product in the Runner Kit. If Sponsor determines in its sole discretion that there is any tampering with the Program, or if technical difficulties compromise the integrity of the Program, the Sponsor reserves the right to cancel or modify the Program. Should the Program be terminated prior to the stated expiration date, a 7-day notice will be given for consumers to submit their information with notice posted at: www.Runhappyu.com. The contents of the Runner Kit are subject to change at Sponsor's discretion. Sponsor's decisions will be final in all matters relating to the Program. Any participant information collected from the Program shall be used only in a manner consistent with the consent given by participants at the time of participation, and with Sponsor's Online Privacy Policy which can be found at: http://www.brooksrunning.com/on/demandware.store/Sites-BrooksRunning-Site/default/About-Content?cid=privacy-policy. The participant's information is shared with Marden-Kane, an independent third party Program Administrator hired by Sponsor, for the purpose of the fulfillment of the Runner Kit and to announce special promotions. Any attempt by any individual to deliberately damage or undermine the legitimate operation of the Program is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor is not responsible for printing errors in these Official Terms & Conditions or in any promotion materials found in print or on any web site.
